Dear Mr. Falls:

In response to your request, I am prepared to develop a proposal for Council
consideration that would rezone your property at 21st and E. Denny Way (Parcel
2), from L-3 to NC-3 65'.  If this legislation is approved by the Council, it
would permit you to develop a project that would consolidate parcels 1 & 2 into
one uniform building site.  If you choose to request an alley vacation in order
to make this consolidation happen, that would require an additional Council
vote.  Approval of the rezone does not constitute approval for the alley
vacation.

Since this rezone was considered in the Central Area Plan, and recommended for
later consideration by the Council, it can potentially be considered as a
legislative rezone.  If this option is agreeable to you, I will ask the
Department of Design, Construction, and Land Use (DCLU) to do the land use
analysis, recommend options, and prepare appropriate legislation for Council
consideration.  When it is ready, the Council will hold the required public
hearing on the proposal and proceed to a final rezone decision by the full
Council.
 

I want to emphasize that the process for consideration of this legislation
provides ample opportunity for public and community comment.  I believe that
the community meeting this fall demonstrated that there is likely to be
substantial public support for a development that would meet the community's
interest in having a safer street environment, additional housing, and a
building that is well-designed and compatible with the other development taking
place along Madison.  I strongly encourage you to continue to work closely with
the community as this process develops.  It is my perception that actions that
would address public safety issues around the current building would be very
helpful in this process.

Please confirm your interest in pursuing this approach, at which time I will
proceed with getting this work in the pipeline for completion in the first
quarter of next year.
